Alabama House Minority Leader Anthony Daniels’ Statement on the Alabama Supreme Court Decision Regarding IVF Treatment


Montgomery, AL – Alabama House Minority Leader Anthony Daniels’ statement regarding the Alabama Supreme Court ruling on In Vitro Fertilization:

“The recent Alabama Supreme Court ruling that the frozen embryos utilized in in vitro fertilization (IVF) are “children” is one more egregious and harmful assault on reproductive health care in Alabama.

This ill-advised ruling will almost certainly put fertility clinics out of business which will negatively impact couples who have chosen this fertility option to begin or expand their family.

This is another example of Alabama denying women access to the reproductive health care they need and deserve. Alabama already has denied women the right to choose with a total abortion ban that provides no exceptions for rape and incest. Now, the state is making it more difficult for those who choose to use IVF by claiming that a frozen egg is a person– relying solely on religious dogma, instead of scientific facts or evidence.

In the dissenting opinion, Justice Greg Cook said it best, “Moreover, there are other significant reasons to be concerned about the main opinion’s holding. No court — anywhere in the country — has reached the conclusion the main opinion reaches,” he wrote, adding that the ruling “almost certainly ends the creation of frozen embryos through in vitro fertilization (IVF) in Alabama.”

Sadly, this ruling is likely to have unintended consequences and speaks to the necessity of stopping government overreach, particularly when it comes to highly personal health care decisions.
